Aurora Cultural Centre Agreement

The Town of Aurora and the Aurora Cultural Centre entered into an agreement on June 9, 2009 for the Centre to provide cultural services on behalf of the Town from the Town-owned Church Street School, located at 22 Church Street.

As per the terms of the agreement, the Town pays the Centre to provide these services in accordance with the June 2008 Strategic and Business Planning Study, as well as the Centre’s objectives, which include:
  • Engaging the community through arts, culture and heritage programming and promotion
  • Reflecting and interpreting the past, present and future of Aurora through creative expression
  • Seeking to make the Centre a dynamic hub in the historic heart of The Town of Aurora with an arts, culture and heritage focus 
Concerns:
 
A report to The Town of Aurora General Committee on October 4, 2011 raised questions about performance measures and governance in the agreement, recommending that Town staff work with the Cultural Centre to develop Key Performance Indicators (KPIs) and establish a reporting relationship that included Council representation on the Centre’s Board of Directors.
 
A further report to General Committee on December 6, 2011 raised more questions relating to performance and governance, recommending that Town staff initiate discussions with the Cultural Centre on these issues.
 
Council Consideration:
 
On February 28, 2012, Aurora Town Council passed a motion to form an ad hoc committee consisting of representatives from Council, the Aurora Cultural Centre Board and the community to develop parameters for a new agreement for the delivery of cultural services.
 
The motion also called for Terms of Reference to be developed and a report brought forward for Council consideration on March 27, 2012.
 
Council Motion:
 
WHEREAS Council directed staff from the Town to report back to Council on KPI’s with regards to the Cultural Services Agreement; and
 
WHEREAS Council directed staff from the Town to work with staff from the Cultural Centre to recommend solutions to Council’s concerns identified in the Town’s Solicitor’s report on the Cultural Services Agreement; and
 
WHEREAS Council directed staff to prepare Terms of Reference for a Museum Curator; and
 
WHEREAS Council directed staff to negotiate with the Aurora Historical Society to acquire the Aurora Historical Artifacts Collection with a working relationship to display them in the Town’s facilities; and
 
WHEREAS these discussions should be held in concert with one another because they will all impact one another; and
 
WHEREAS these discussions should take place in a structured and timely manner and be representative of all parties involved; and
 
WHEREAS Council desires to negotiate the parameters of the relationship between the Town and those that deliver cultural services on behalf of the Town; and
 
WHEREAS it is the expectation and intention that a new agreement be in place as soon as possible; and
 
WHEREAS the Culture Centre Board recognizes that the Cultural Services Agreement must be renegotiated to address the concerns identified in the Town’s Solicitor’s report; and
 
WHEREAS the first step necessary as outlined in the current Cultural Services Agreement, that if the current Cultural Services Agreement is to be replaced, then notification must be given to the Board.
 
THEREFORE BE IT RESOLVED THAT an Ad Hoc Committee be struck to develop parameters for a new agreement for the delivery of cultural services for the Town of Aurora, consisting of: Cultural Centre Board members, members of Council, and members of the Community; and support be provided by the Director of Parks and Recreation Services and the CAO; and staff be directed to prepare the Terms of Reference for the Committee for Council’s consideration and a report be provided to Council by March 27, 2012.
 
New Terms of Reference:
 
On March 27, 2012, Aurora Town Council approved new Terms of Reference for an Ad Hoc Negotiating Working Group to develop a new agreement of the delivery of cultural services by the Aurora Cultural Centre (ACC). The Terms of Reference were modified at a Special Meeting of Council on April 5, 2012.

As part of the new terms, Aurora Town Council will have representation on the ACC Board of Directors and will approve the ACC budget during the Town’s budget process.
